PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to issue direction directing the transfer the investigation of the Crime No.18 of 2021 dated 04.08.2021 from the 2nd Respondent to the 1st Respondent.

O R D E R

This Criminal Original Petition has been filed to issue direction to transfer the investigation in Crime No.18 of 2021 dated 04.08.2021 from the file of the Second Respondent to the file of the First Respondent.

2. It is the contention of the learned Counsel for the Petitioner that the Petitioner had approached this Court on earlier occasion by filing Crl.O.P(MD) No.10060 of 2022, in which, this Court had directed the Second Respondent to complete the investigation in Crime No.18 of 20121 and lay the Final Report before the jurisdictional Magistrate within three months from the date of receipt of copy of this order. The order was passed on 08.06.2022, but, till date, they had not completed the investigation. Therefore, he seeks to transfer of the investigation. 2/5

3.The learned Government Advocate (Crl. Side) appearing for the Respondents 1 and 2 submits that the accused are absconding and he undertakes to file a Final Report before the Court concerned within twenty days.

5.Recording the submission made by the learned Government Advocate (Crl. Side), the Second Respondent is directed to file the Final Report within twenty days from the date of receipt of copy of this order.

6. With the above direction, this Criminal Original Petition is disposed of. No costs.
