ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the second respondent not to harass the petitioner under the guise of enquiry on the basis of the petitioner's representation dated 01.09.2024.

2. The learned Government Advocate (Criminal Side) appearing for the respondents would submit that a brutal murder was committed on 17.08.2024 and on that basis, FIR came to be registered in Crime No.82 of 2024 against unknown accused. He would further submit that in the investigation, they came to know that the petitioner's cell phone was located nearby murder place and that they have summoned the petitioner directing him to appear and in pursuance of the same, the petitioner appeared on 20.08.2024 and 22.08.2024 and that since he was not cooperating with the investigation, they have summoned him again to appear but after receipt of the summons, he has filed the present petition.

3. At this juncture, the learned counsel appearing for the petitioner would submit that the petitioner is ready to appear before the second 2/4

respondent and co-operate with the investigation.

4. Recording the same, the second respondent is directed to issue written summons to the petitioner and on receipt of the same, the petitioner is directed to appear before the second respondent and the second respondent is directed to conduct enquiry within a period of one week from the date of the petitioner's appearance.

5. With the above direction, the Criminal Original Petition stands disposed of.
