PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus to call for the records relating to the impugned order of suspension vide in Pa.R.1071/2023/O.Na. dated 28.06.2023 and the consequential order vide in Pa.R.1071/2023/O.Na. Dated 30.06.2023, passed by the 3rd respondent and quash the same and consequently directing the respondents to allow the petitioner to retire from service with effect from the date of superannuation and disburse the retirement benefit such as Gratuity, Employees Provident Fund and Earned Leave Salary and other monetary benefits payable to him within a time frame fixed by this Court.

Learned Additional Government Pleader appearing for the respondents has placed on record the letter sent by the petitioner to the third respondent dated 15.09.2025 confirming that he has received all the
retirement benefits subsequent to the filing of this writ petition. As seen from the said letter, the relief sought for by the petitioner has been achieved as confirmed by the letter of the petitioner dated 15.09.2025.
2. However, learned counsel for the petitioner would submit that he needs time to get instructions from the petitioner.
3. This Court is of the considered view that no useful purpose would be served, if this writ petition is allowed to be kept pending, in view of the aforesaid letter sent by the petitioner to the third respondent dated 15.09.2025 confirming that he has received all the retirement benefits subsequent to the filing of this writ petition.
4. After recording the aforesaid letter of the petitioner dated 15.09.2025 confirming that he has received all the retirement benefits subsequent to the filing of this writ petition, this writ petition is disposed of. However, if the learned counsel for the petitioner, after getting instructions, finds that the petitioner has not received the retirement benefits as stated in the petitioner's letter dated 15.09.2025, liberty is granted to the petitioner to
revive this writ petition. No costs. Consequently, connected miscellaneous petitions are closed.
