Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Writ Petition, praying this court to issue a Writ of Mandamus, directing the Respondents No.1 to 3 to issue patta to the petitioner in respect of land about an extent of 0.01.0 Ares equalling 2.5 cents comprised in Survey Nos. 46 Alangudi Village, Alangudi Taluk, Pudukkottai district on the basis of the proceedings of the 1st Respondent in Na.Ka.No. E2, 47761/2020, dated 20.12.2000 and for other reliefs.

ORDER

These writ Petitions are filed seeking a direction to the respondents 1 to 3 to issue patta to the petitioner in respect of the land situated in Survey Nos. 46 Alangudi Village, Alangudi Taluk, Pudukkottai District, in the light of the proceedings of the 1st Respondent in Na.Ka.No. E2, 47761/2020, dated 20.12.2000.

According to the petitioner, the water body called Ramachandra Kulam situated in survey No.46 in Alangudi Village, Alangudi Taluk, Pudukkottai District, was originally classified as a water body called RamachandraKulam. By the proceedings of the first respondent dated 20.12.2000, the said survey number was sub-classified into 103 sub division numbers and some of the sub divisions were reclassified as Natham. However, major portion of the original survey number was retained as a water body.

In respect of the water body in the above mentioned survey number, a writ petition was filed before this Court in W.P.(MD)No.23977 of 2023, seeking removal of the encroachment and the said writ petition was disposed of by directing the official respondents to conduct survey and take action against the encroachers according to the provisions of the Tamil Nadu Urban Local Bodies Act, 1998. The petitioners were also arrayed as respondents in the said writ petitions. Since the prayer sought for by the petitioners will go against the directions issued by the Hon'ble Division Bench of this Court, this Court is not inclined to entertain the writ petition filed by these petitioners.

4. Accordingly, these Writ Petitions are dismissed with liberty to the petitioners to approach the very same Hon'ble Division Bench, seeking redressal of their grievances, if any.
