COMMON ORDER Heard the learned counsel on either side.

2.By the impugned notice, it has been notified by the third respondent that encroachments in the petition mentioned highway would be removed. The petitioners apprehending that they would be affected, filed these writ petitions and obtained interim order of stay. It is seen that the petitioners have not been put on notice before passing the impugned order.

3.The third respondent is permitted to issue fresh notice to both the writ petitioners specifying the details and particulars. The petitioners will be given adequate opportunity to establish their case. After such due enquiry, final order shall be passed on merits and in accordance with law. The impugned orders will abide by the said final orders that may be passed by the third respondent. It shall be kept in abeyance till then. 4.These writ petitions are disposed of accordingly. No costs.
