It is submitted by learned counsel for the petitioner that as per the status report, though respondent Police admitted that the offence has been committed, except examination of thirteen witnesses as mentioned in Paragraph No.4, the status report, there is no substantial progress in the investigation and 2/6
accused are not arrested and misappropriated amount of Rs.1,27,00,000/- (Rupees One Crore and Twenty Seven Lakhs only) was not recovered. It is further submitted by learned counsel for the petitioner that even if the investigation is completed sought for transferring the case to second respondent Police.
3. Mr.Mr.V.Raghavachari, learned Senior Counsel appearing for the accused submits that in order to delay the proceedings, the present petition is filed.
4. Learned Government Advocate (Criminal Side) submits that the investigation has already been completed and charge sheet is made ready and will be filed shortly.
5. Once investigation has already been completed as reported by learned Government Advocate (Criminal Side), this petition which is filed for transfer of investigation to second respondent agency becomes infructuous. However, since the petitioner has raised objections to the investigation and pointed out the lapses in the investigation, the Deputy Commissioner of Police, 3/6
Trichy City (South), is directed to verify the charge sheet and in case, if there are any lapses in the part of the investigation, a proper directions may be given to the Investigating Officer. The petitioner is also permitted to file the representation before the concerned Deputy Commissioner of Police, Trichy City (South) pointing out the investigation, if any, so that, the officer concerned will verify the investigation with reference to the representation. The Deputy Commissioner of Police, Trichy City (South), is directed to consider the representation of the petitioner and complete the verification of the charge sheet within a period of four weeks from the date of receipt of a copy of this order.
