Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the 1st respondent to instruct the 2nd respondent not to harass the petitioner and his family members on the guise of enquiry in the family dispute.

O R D E R

The petitioner, who is working as a doctor in the Government hospital, has filled this petition that the respondent police is harassing him under the guise of an enquiry.

2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the respondents 1 & 2 submits that the third respondent/the wife of the petitioner has lodged a complaint as against him and the complaint has been forwarded to the Social Welfare Officer as the issue is out of matrimonial dispute and the same is now pending before the Social Welfare Officer.

3.Considering that this issue is out of matrimonial dispute, the matter has been rightly forwarded to the Social Welfare Officer and the same is now pending before the Social Worker Officer. The respondent police is directed not to harass the petitioner. The respondent police shall refer this petitioner to the Social Welfare Officer. The petitioner shall also appear before the Social Welfare Officer and cooperate for the enquiry. In the event, no amicable settlement has been 2/4

arrived between the parties, and the complaint of the defacto complainant makes out a cognizable offence, it is upto the respondent police to register the complaint, otherwise close the complaint within a period of six weeks.

4.With the above directions, this Criminal Original Petition is disposed of.
