PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to not to interfere with the day today affairs of the petitioner's recreation club, namely, "M.P.Recreation Club" at Narasingam, Othakadai, Madurai District and permit the petitioner to avail the facilities provided for playing rummy and consider the representation of the petitioner, dated 11.08.2023. O R D E R

This Writ Petition is filed under Article 226 of the Constitution of India seeking for a Mandamus directing the respondent Police not to withhold the permission to open the Recreation Club, namely, "M.P.Recreation Club" at Narasingam, Othakadai, Madurai District.

2. It is submitted by the learned counsel for the petitioner that the petitioner has registered a Club, by name, "M.P.Recreation Club" under the Tamil Nadu Societies Registration Act, 1975, on 10.08.2023 with proper Bylaws and they made a request to the respondent Police as per the representation, dated 11.08.2023 to permit the petitioner to run the Club along with the said petition. The petitioner has rightly enclosed the copies of the By-laws, the copies of Registration Certificate and the copies of the members of the Recreation Club. It is also submitted that the petitioner would play the card game of rummy by strictly following the Rules and will not violate the Game Act. Therefore, sought for suitable directions.

Learned Government Advocate (Criminal Side), on the other hand, submits that the petitioner has filed a representation, dated 11.08.2023, in spite of giving number of requests, the petitioner has not submitted the suitable documents in order to process his request for consideration whether to grant permission or not.

4. Learned counsel for the petitioner submits that the petitioner is prepared to appear before the respondent Police and the Police may be directed by this Court and therefore, sought for suitable directions.

5. Considering the submissions made by both sides, this Writ Petition is disposed of, directing the petitioner to appear before the respondent Police on 27.08.2023 along with whatever required documents to be submitted, on which, the respondent Police are directed to consider the same and dispose of the representation as expeditiously as possible not later than two weeks from the date of receipt of a copy of this order.
