ORDER

This Contempt Petition has been filed seeking orders to punish the contemnor for the deliberate and willful disobedience of the order passed in Crl.O.P(MD)No.3792 of 2023, dated 02.03.2023. 1/4

2.When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) would submit that the charge sheet was filed through e-filing on 25.08.2022, that since the amount recovered was neither mentioned in the charge sheet nor remanded, it was not taken on file and that subsequently, after production of the case property, the final report was taken on file on 15.11.2023 in S.T.C.No.483 of 2022 and the same is pending on the file of the learned Judicial Magistrate No.VI, Madurai.

3. The learned Government Advocate (Criminal Side) would submit that the jurisdictional Court has already issued summons to the present petitioner, but, after receipt of summons, the petitioner has not chosen to appear.

4. At this juncture, the learned counsel for the petitioner would submit that he has not received any summon.

5. Whatever it is, since the charge sheet was already taken on file and summons were ordered to be issued, the jurisdictional Court is directed to send summons to the revision petitioner and on receipt of the summons, the petitioner is directed to appear before the concerned Court. 2/4

6. With the above directions, the Contempt Petition is disposed of. 11.12.2023 NCC : Yes/No Index : Yes/No Internet : Yes/No das To The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai.
