PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of Civil Procedure Code, to withdraw and to transfer the Divorce Petition in H.M.O.P.No.311 of 2021 on the file of the Sub-Court, Kanchipuram to Family Court, Madurai.

O R D E R

This Transfer Civil Miscellaneous Petition has been filed to withdraw H.M.O.P.No.311 of 2021 from the file of Subordinate Court, Kanchipuram and transfer the same to the file of Family Court, Madurai.

2.The learned counsel for the petitioner submitted that the respondent/husband has filed H.M.O.P.No.311 of 2021 before the SubCourt, Kanchipuram, Kanchipuram District. Since the petitioner is residing at Madurai, she cannot able to travel from Madurai to Kanchipuram to attend the Court hearings. Hence, she seeks to transfer the case as prayed for.

3.Considering the facts and circumstances of the case and also considering the submission made the learned counsel for the petitioner, H.M.O.P.No.311 of 2021 is ordered to be withdrawn from the file of Subordinate Court, Kanchipuram and transferred to the file of Family Court, Madurai and to dispose of the same as per law as expeditiously as possible.

Tr.C.M.P(MD).No.565 of 2021 4.In the result, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
