This criminal original petition has been filed for expediting the trial in C.C.No.385 of 2021 on the file of the Judicial Magistrate No.I (FAC), Madurai.

2.Though the case is of the year 2017, cognizance was taken only this year. I am therefore not in a position to give the direction as sought for. However, the petitioner's counsel alleges that even summons have not been served on the accused. This is because the petitioner had issued contempt notice against the respondent.

3.The respondent should not take the issuance of the notice personally. The petitioner is after all seeking to exercise his legal rights. Therefore, the respondent is directed to serve the summons on the accused at the earliest.

4.The criminal original petition is disposed of with the aforesaid direction.
