PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to forbear the respondents herein from in any manner constructing the Overhead Tank adjacent to the back side of the Vaadivasal, Alanganallur Jallikattu area and direct to conduct an Independent Safety 1/5
Feasibility Study and explore alternative site for such construction of the Overhead tank without affecting the Alanganallur Jallikattu area by considering the representation submitted by the petitioner dated 11.07.2025 within the time stipulated by this Court.

ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The negative relief sought for in the present writ petition cannot be considered. The third respondent is in the process of constructing the Overhead Water Tank for the benefit of the people to supply the drinking water. It is a welfare scheme being implemented by the Panchayat for providing drinking water to the residence of that Village. The reasons stated by the petitioner that the same may obstructing the Jallikattu festival is not sound enough to consider the negative relief. The space constrain raised by the petitioner is objected by the Government Pleader since they are constructing the pillars only and it is a overhead water tank which may not be cause any inconvenience to the people. That apart, the water tank is under construction in the Government land alone and the construction is 2/5
also for the public purpose. Thus, the petitioner is not established the right.
2. In view of the above, the writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S., J.) & (A.D.M.C., J.) 06.08.2025 NCC : Yes / No Index : Yes / No am 3/5
