For Respondent : Mr.SS.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.136/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 294(b), 324 and 506(ii) of I.P.C, in Crime No.136 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to the civil dispute between the parties, on 29.07.2022 at about 10.00 a.m, when the husband of the defacto complainant proceeding towards the farm of his in-laws, the accused person waylaid him and abused him in filthy language and assaulted him with wooden log and caused injury to him.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. This the second anticipatory bail application. Earlier anticipatory bail application filed by the petitioner in Crl.OP(MD) No.15278 of 2022 was dismissed by this Court on 02.09.2022. He https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.17575 of 2022 further submitted that the petitioner and the defacto complainant are very close relatives.

4. The learned Government Advocate (Crl. Side) for the respondent police submitted that earlier anticipatory bail application filed by the petitioner was dismissed by this Court, on the ground that severe injury has been caused to the injured, he was in coma stage and taking treatment in the hospital. Now, the injured is in his house and he is not in a position to look after his daytoday affairs. 5.In view of the above, absolutely, I find no change of circumstance in this petition. Accordingly, this Criminal Original Petition is dismissed.
