Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in Rc.No. 6959184/GB-2(1)/2024 dated 12.08.2024 issued by the 2nd respondent quash the same as illegal and consequently directing the Respondent Nos.1 and 2 to include the petitioner's name in the Approved List of Inspectors of Police fit for appointment by recruitment by transfer as Deputy Superintendent of Police (Category-I) for the year 2023-2024 forthwith within the time stipulated by this Hon'ble Court. This writ petition is filed challenging the impugned order dated 12.08.2024 issued by the 2nd respondent and seeking consequential direction to the 1st and 2nd respondents to include the petitioner's name in the approved list of Inspector of Police fit for appointment by recruitment by transfer as Deputy Superintendent of Police (Category-I) for the year 2023-2024.

2. Heard learned Counsel for petitioner and Mr.Om Prakash, learned Government Advocate appearing for respondents and perused the materials available on record.

Through the impugned proceedings dated 12.08.2024, the case of the petitioner was rejected for inclusion in the approved list of Inspectors of Police fit for promotion to the post of Deputy Superintendent of Police (Category-I) for the year 2023-2024, on the ground that the petitioner's probation in the cadre of Inspector of Police had not been declared. Hence, the petitioner has approached this Court by filing the present writ petition, contending that his probation is deemed to have been declared and that the impugned order, passed solely on the ground of non-declaration of his probation in the cadre of Inspector of Police, is illegal and arbitrary.

Today, when the matter is taken up for consideration, the learned Counsel appearing for the petitioner has brought to the notice of this Court a copy of the proceedings bearing No.R.O.176/2025 dated 02.06.2025, whereby the Deputy Inspector General of Police declared the petitioner's probation in the post of Inspector of Police as deemed to 3/6
have been declared. Accordingly, necessary proposals were also submitted to the Government through proceedings in Rc.No. 6959184/GB-2(1)/2024 dated 24.06.2025, proposing to include the name of the petitioner among the eligible candidates for promotion to the post of Deputy Superintendent of Police for the panel year 2023-2024. However, without considering the same, the second respondent appears to have effected promotions, ignoring the claim of the petitioner, through Police Note No.7 dated 10.03.2026.

From the above, it is evident that the sole ground on which the impugned proceedings dated 12.08.2024 were issued is non-existent, and the case of the petitioner has also been considered by the respondents themselves, with an appropriate proposal having already been submitted to the Government as early as on 24.06.2025. In view of the subsequent developments that have taken place during the pendency of the writ petition, the relief sought for in this writ petition has now become infructuous, except to the extent of considering the proposal dated 24.06.2025 submitted by the second respondent to the first respondent. 4/6
6. Hence, this Court is of the considered view that it would be appropriate to dispose of the writ petition. Accordingly, this Writ petition is disposed of and the first respondent is directed to consider the proposal submitted the 2nd respondent through proceedings in Rc.No. 6959184/GB-2(1)/2024 dated 24.06.2025 and pass appropriate orders at any date within a period of eights weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
