ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 379 (Sand Theft), in Crime No.236 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 23.09.2022 at about 04.00AM, the accused has transported 5 units of gravel sand by using JCB vehicle. Hence, the complaint.
3.On the side of the petitioner, it is stated that a false case was foisted against the petitioner. The petitioner is noway connected with the offence. Hence, prays to release him on anticipatory bail.
4. On the side of prosecution, it is stated that petitioner is having 34 previous cases and prayed to dismiss the petition. 5.Considering the nature of the case and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to him.
