The writ petition is filed seeking a direction to the respondents to consider the petitioner's representation dated 11.07.2025 seeking rectification of extent in patta No.12399 in respect of the property situate in S.Nos. 93/2A2B and 93/2A3B in Nallur Village, Madurai South Taluk, Madurai District.
2.Mr.D.S.Nedunchezian, learned Government Advocate takes notice for the respondents. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself. 2/6
3.According to the petitioner, the petitioner's father Madavan and his brother Pitchai purchased 1.25 acres of land in the above mentioned survey numbers under registered sale deed dated 26.06.1998 from one Veeran. The northern half of the said property has been in possession of the petitioner's father and after his death his legal representatives including the petitioner are in possession of the same. The southern portion has been in possession and enjoyment of the above said Pitchai and his legal representatives. Patta for the subject property has been issued in the name of the petitioner and other legal heirs of Madavan in patta No.12399. In the patta, the extent of the property is wrongly mentioned instead of correct extent of 62.5 cents. Therefore, instant representation dated 11.07.
2025 has been filed by the petitioner seeking issuance of patta by correcting the extent, but the same has not been considered. Hence, he has come before this Court. 4.The learned Government Advocate who takes notice for the respondents would submit that the representation submitted by the petitioner will be considered in accordance with the law.
5.The petitioner's father and his brother said Pitchai said to have purchased 1.25 acres of land in the above mentioned survey numbers. The petitioner has not produced any document to show that the northern half was allotted in favour of the petitioner's father Madavan. In such circumstances, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation of the petitioner dated 11.07.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, legal representatives of the above mentioned Pitchai.
6.With the above direction, this writ petition stands disposed of. No costs.
