PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 2nd and 3rd respondents to consider the Petitioner's Application, dated 07.07.2023 U/s. 69(1) of Tamil Nadu Wakf Act, 1995, and place it before the 1st respondent Board by giving an opportunity to all member of Jum-A-mosque, Arasarkulam Village and to frame the scheme U/s. 69(1) of Tamil Nadu Wakf Act, 1995, to the petitioner's Jum-A-mosque, Arasarkulam village, Aranthangi Taluk, Pudukottai District in accordance with law, within time stipulated by this Court.

This writ petition is filed for Mandamus, to direct the 2nd and 3rd respondents to consider the Petitioner's Application dated 07.07.2023 u/s. 69(1) of Tamil Nadu Wakf Act, 1995 and frame the scheme.

2. Heard Mr.G.Jeremiah John, the Learned Counsel appearing for the petitioner and Mr.G.Chandrasekar, the Learned Standing Counsel appearing for the respondents. Perused the material documents available on record. 2/6

3. The Learned Standing counsel appearing for the respondents submitted that the appropriate authority is first respondent but the petitioner has not submitted any application to the first respondent, but he has submitted application to the second and third respondents.

4. Therefore, the petitioner is directed to submit an application to the first respondent within a period of one week, from the date of receipt of a copy of the order. Thereafter, the respondents shall consider the petitioner's application, within a period of four months from the date of receipt of the petitioner's application.
