For Respondent : Mr.R.M.Anbunithi Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL UNDER SECTION 482 OF BNSS PRAYER :- To enlarge the petitioner on bail in the event of his arrest by the respondent police in connection with Crime No. 3 of 2002 in Spl S.C No. 12 of 2014 pending on the file of the learned Chief Judicial Magistrate Court, Theni. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offence under Sections 120 B, 467, 468, 471, 167, 477(A) of IPC, in Crime No.3 of 2002, seeks anticipatory bail.

2. The case of the prosecution is that the due to ill health, the petitioner could 1/3

not appear before the trial Court on 09.11.2023 for hearing. Hence, the learned Chief Judicial Magistrate issued non-bailable warranted to the petitioner.

3. Heard the learned counsel on either side.

4. Considering the fact that the petitioner was earlier regularly appearing before the concerned Court in Spl.C.12 of 2024 and considering the fact that non-bailable warrant was issued on 23.11.2023 and considering the arguments made by the learned Counsel for the petitioner that the petitioner was not well, this is not a case where this Court can grant anticipatory bail. The petitioner has to approach the same Court for recall of the non-bailable warrant. Considering the pleading of the learned Counsel for the petitioner that the petitioner was not well and therefore, he was unable to appear, as and when an application is filed for recalling the non-bailable warrant, the same shall be considered on the same day.

5. With the above observation, this Criminal Original Petition is disposed of sd/- 06/09/2024 / TRUE COPY / / 10 /2024 Sub-Assistant Registrar (C.S. I / II / III / IV) Madurai Bench of Madras High Court, Madurai - 625 023.
