ORDER : The Court made the following order :- The petitioner / A4, who was arrested and remanded to judicial custody on 01.11.2024 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 & 29(1) of NDPS Act, 1985, in Crime No. 491 of 2024 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 31.10.2024, at about 09.00 p.m, when the respondent police was on routing vehicle checkup at Gurumburmedu, on suspicion, they intercepted one car bearing Reg.No.TN-02-AQ-2124, which was escorted by two bikes bearing Reg.Nos.TN-18-BL-9823 and TN-63-BS-5375 and found 150 kg in 75 bags, each bag containing 2 kg of ganja. Hence, the respondent police registered a case against the petitioner and three others for the aforesaid offences and also arrested them. Hence, this petition.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. 2/5

He would further submit that earlier bail application filed before the Additional District and Sessions Judge Special Court fro R.C and NDPS Act Cases, Pudukkottai, in Crl.M.P.No.5864 of 2024 was dismissed on 26.11.2024 and the petitioner is a college going student and he has no previous case and he has been arrested and remanded to judicial custody on 01.11.2024. Therefore, he prayed to grant bail for the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that totally 4 accused are involved in this case including the petitioner and all are in jail and the quantity of contraband involved in this case is a commercial quantity and the presence of the petitioner was found in the scene of occurrence. He further submitted that this is a second bail petition. Earlier bail petition filed by the petitioner was dismissed. Suppressing the same, present petition has been filed and the petitioner is having IPC cases and there is no change of circumstances. Hence, he strongly opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity of contraband involved in this case is a commercial quantity and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
