PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider the representation dated 17.07.2025 consequently, to restore and maintain the new building in the place of previously existed ancient monument building as "Rani Mangamma Samudhaaya Nala Koodam for public use" within the time frame fixed by this Court.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Writ Petition has been instituted to direct the respondents to consider the representation of the petitioner dated 17.07.2025 and consequently, to restore and maintain the new building in the place of previously existed ancient monument building as "Rani Mangamma Samudhaaya Nala Koodam for public use" within the time frame fixed by this Court. 2.Admittedly, the subject building was in dilapidated condition and the Tahsildar concerned has also passed an order for demolition of the said building. 2/5

The said order was implemented and the building has already been demolished. Thus, restoration of the said structure would not arise at all. 3.The relief sought for in the present Writ Petition to consider the representation cannot be granted and such direction if issued would do no service to the cause of justice. Contrarily, the litigant will be back again by filing another Writ Petition. The building is non-existing and that being the facutm admitted, there is no reason to issue any such direction to the authorities competent. If the building was existed in the Government land, then the said land is to be protected by the Government.

4.With the above observation, this Writ Petition stands dismissed. No costs.
