ORDER

This writ petition has been filed seeking for issuance of writ of mandamus directing the second respondent to register the sale deed dated 28.08.2024 in respect of the property comprised in New Sy.No.169/6C of Agastheeswaram Town Panchayat, Agastheswaram Taluk, Kanyakumari District about 3 cents 800 square links equal to 153.79 Square Meter with the house bearing Door No.5/19/2020 covered within the boundaries of North-The land belongs to Balakrishnan, South-The land belongs to Ajithkumar, EastPathway West-The land belongs to Vickramaraj.

2. Heard Mr.K.P.Krishna Doss, learned counsel appearing for the petitioner and Mr.P.Subbaraj, learned Special Government Pleader appearing for the respondents.

3. The subject property in New Sy.No.169/6C of Agastheeswraam Revenue Village and Taluk, Kanyakumari District, belongs to the petitioner. She intended to sell the property to one Jebina. It is the grievance of the petitioner that when she presented the document for registration before the second respondent, the same was returned without passing any order. Hence, she seeks direction of this Court.

4. The learned Special Government Pleader appearing for the respondents, on instructions, would submit that if the petitioner presented the document, then appropriate order would be passed.

5. In view of the above, this Court directs the petitioner to present the document before the registering authority. On such presentation being made, it is for the registering authority to pass appropriate order, in the event of refusal, there must be a proper order.

6. With the above direction, the Writ Petition stands disposed of. No costs.
