Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd and 3rd Respondent to measure demark the Petitioner Scheduled Property in T.Survey No.231/9B6, Manikkapuram, Uppukottai Village, Bodinayakkanur Taluk, Periyakulam Sub Register, Theni District in the light of necessary payment paid by the petitioner, based on the receipt number (Receipt No. 2025/0123/25/005362) dated 30.07.2025 with the help of the 6th Respondent to give adequate Police Protection till the completion of measuring the above said properties. ORDER

The petitioner herein seeks a direction to the respondents 2 and 3 to survey the property situated in T.Survey No.231/9B6 at Manikkapuram, Uppukottai Village, Bodinayakkanur Taluk, Periyakulam Sub Register, Theni District, by considering the application of the petitioner dated 30.09.2025.

2. Heard the learned counsel appearing for the petitioner, Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents 1 to 3 and Mr.M.Vaikkam Karunanithi, learned Government Advocate (Crl.Side) who takes notice for the respondents 4 to 6.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, the subject property was purchased by him from one Senthil Kumar under a registered Sale Deed dated 15.07.2016. The petitioner submitted an online application on 11.02.2025 in A.No.2025/6123/25/003710, seeking survey of the subject property. However, the same has not been considered. Hence, the petitioner has come before this Court.

5. The learned Government Advocate who takes notice for the respondents 1 to 3 would submit that the patta for the subject property stands in the name of the petitioner's vendor namely Senthil Kumar and hence, the request of the petitioner has not been considered. 3/6

In view of the same, without expressing any opinion on the merits of the matter, the respondents 2 and 3 are directed to consider the online application of the petitioner dated 11.02.2025 and pass final orders on its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, his vendor Senthil Kumar, neighboring land owners and other interested parties.

7. The writ petition is disposed of with the above observations. No costs.
