For Respondent : Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.Not Known of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 406 & 420 of I.P.C., in Crime No. 1/4

Not Known of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant lodged a complaint before the Superintendent of Police stating that in the year of 2016, he had availed vehicle loan with one private financial institution namely 'Equitas' and received a sum of Rs.2,50,000/- as a loan for his vehicle bearing registration No.TN 75 D 5259, four wheeler. He repaid only two installments i.e., Rs.20,000/-. Due to non payment of pending installments the petitioner who was working as an Assistant Sales Manager had taken away his vehicle in order to sell the same and settle the loan amount. But, he did not settle the loan amount to the said company. Cheated him. The said complaint was forwarded to the respondent police. 3.

The learned Additional Public Prosecutor would submit that on the basis of the complaint given by one Mathusoothanan, enquiry was undertaken. During the course of enquiry, this petitioner has appeared and given statement that he will take steps to get NOC from concerned company. On that basis the above said enquiry was closed.

4.Now this petition has been filed seeking anticipatory bail regarding the above said closed enquiry, on the ground that he was relieved from the above said Equities 2/4

company by the order dated 6th December 2018, wherein it was stated that the petitioner was relieved on 14th October 2018 itself. According to him after that he cannot approach the company for taking steps. 5.The petitioner has to workout his remedy through appropriate proceedings. This petition has been filed unnecessarily.
