ORDER
By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself. 2.The writ petition has been filed challenging the impugned transfer order dated 30.07.2025 issued by the 5th respondent herein by transferring the petitioner from TELC Primary School to TELC Primary 2/6
school, Melandal, situated at Paramakudi Taluk, Ramanathapuram District.
3. The learned counsel for the petitioner would submit that initially the petitioner was appointed as Assistant Teacher and subsequently, he was promoted as Headmaster and as such, working in the said 5th respondent school in the said post. While so, the 6th respondent, who is working in the said school, was promoted as Headmistress of the 5th respondent school and in order to accommodate the 6th respondent in the said school, the petitioner, who is a senior to the 6th respondent, was transferred to Melendal at Paramakudi Taluk. However, the learned counsel would submit that though the transfer order was issued on 25.07.2025, the petitioner was not relieved and subsequently, the impugned order dated 30.07.2025 was issued to him thereby transferring him to TELC School at Iyyampettai, Sattur Taluk, Virudhunagar District. Challenging the said transfer, the petitioner is before this Court.
4. Per contra, the learned counsel for the 5th respondent would submit that though it is true that the petitioner was transferred on 3/6
25.07.2025 to Melendal, Paramakudi Taluk, subsequently, the petitioner made a request to transfer him to nearby school by considering his representation. Hence, the petitioner was issued with the transfer order on 30.07.2025 to Iyyampettai, Sattur Taluk, Virudhunagar District and once the petitioner exercised his option for transfer from the transferred place to the new place, he cannot file a writ petition before this Court challenging the said transfer. It is also submitted that the petitioner is working in the 5th respondent school for 18 years and hence, he was transferred.
5. I have considered the rival submissions and perused the materials available on record.
6. Considering the said submissions now made by the learned counsel for the contesting respondent to the effect that on the request made by the petitioner to exercise his option to transfer him to the nearby school, the petitioner has been given transfer to TELC School at Iyyampettai, Sattur Taluk, Virudhunagar District. When the petitioner was given transfer to the nearby school as per his request made, the 4/6
challenge made to the transfer order is not tenable. Accordingly, the writ petition is dismissed. No costs. Consequently connected Miscellaneous Petitions are closed.
