PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 1st respondent the District Collector / District Level Committee (District Level Empowered Committee for medical Reimbursement) to pass order to reimburse balance medical treatment expenses of Rs.10,07,000/- to the petitioner towards the medical expenses incurred by the petitioner for his wife treatment with 6 percent interest within a time stipulated by this Court.

ORDER

By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

2. This writ petition has been filed for a Mandamus to direct the 1st respondent the District Collector / District Level Committee (District Level Empowered Committee for medical Reimbursement) to pass order to reimburse balance medical treatment expenses of Rs.10,07,000/- to the 2/5

petitioner towards the medical expenses incurred by the petitioner for his wife treatment with 6 percent interest within a time stipulated by this Court.

3. The grievance of the petitioner is that he was appointed as Grade II Constable in the year 1985 and subsequently promoted as Sub Inspector of Police and retired from service on attaining the age of superannuation on 30.04.2020 and he is receiving pension. His wife suffered heart ailment and since the petitioner is a subscriber of medical insurance scheme, he is entitled for medical reimbursement. Accordingly, he made a representation to the first respondent to reimburse the amount spent towards his wife's treatment. Since the same has not been considered so far, the petitioner is before this Court.

4. Heard the learned counsel for the petitioner.

5. Considering the limited scope of the matter, without adverting to the merits or the contentions made, the writ petition is disposed of with a direction to the first respondent to consider the representation of the 3/5

petitioner and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. No costs.
