Respondents Prayer :- Writ Petition, filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order passed by the 3rd Respondent herein vide his Na.Ka.No. G2/30994/2016, dated 16.04.2018, quash the same and consequently direct the respondents to grant patta for an extent of 0.20.0 aires of land comprising in S.No.

34/29 of Panniyaan Village, Usilampatti Taluk, Madurai District, on the basis of the order passed by the Appellate Authority and 4th Respondent vide Na.Ka.No. 1213/2015/A2, dated 04.07.2016.

ORDER:- This Petition coming on for hearing on this day under the caption 'Extension of time for Lower Court' and upon perusing earlier order dated 26.08.2022 and the requisition submitted by the District Munsif-cum-Judicial Magistrate No.1, Usilampatti, in D.No.782/2024, dated 16.11.2024, through Principal District Judge, Madurai, in D.No.11453/2024 dated 22.11.2024 seeking further three months time to dispose of the case in O.S.No.1 of 2015, this Court made the following Order:

This Court, in the above Writ Petition, by an order, dated 26.08.2022, directed the learned District Munsif-cum-Judicial Magistrate No.1, Usilampatti, to dispose of the suit in O.S.No.1 of 2015 on merits and in accordance with law within a period of eight weeks from the date of receipt of the order.

2. Now, the learned District Munsif-cum-Judicial Magistrate No.1, Usilampatti, has submitted a letter, dated 16.11.2024, requesting for further time to dispose of the suit, stating that certain interlocutory applications were filed, and, because of the pendency of the said interlocutory applications, the suit could not be taken up for final disposal. The learned District Munsif-cum- Judicial Magistrate No.1, Usilampatti, further states that the suit is posted for trial and, accordingly, has sought for further time to dispose of the suit.

3. Considering the request of the learned District Munsif-cum-Judicial Magistrate No.1, Usilampatti, the time is extended by three months from today for disposing of the suit.

4. It is to be mentioned that the order of this Court was passed on 26.08.2022 and, even after a lapse of almost two-and-a-half years, the matter has been kept pending by the learned District Munsif. Therefore, it is made clear that no further extension of time will be granted and the direction of this Court must be complied with in letter and spirit within the extended period of three months.
