COMMON ORDER : The Court made the following order :- The petitioners/Accused No.5 & 3 apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323, 506(ii)I.P.C., and Section 4 of TNPWH Act, in Crime No.58 of 2022 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that due to previous enmity with regarding to take the students in the Van to the School, the petitioners said to have abused the defacto complainant in filthy https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). Nos.18235 & 18236 of 2022 language and assaulted the mother of the defacto complainant and caused simple injury. Hence, the present complaint came to be registered.

3.This the second anticipatory bail application. Earlier anticipatory bail application filed by the petitioners in Crl.OP(MD) No.16306 of 2022 was dismissed by this Court, on 09.09.2022, on the ground that the petitioners are having previous cases and they are the habitual offender. This petition came to be filed on the very same ground.

4.Absolutely, I find no change of circumstance in this petition. Accordingly, this Criminal Original Petitions are dismissed.
