ORDER

This Criminal Miscellaneous Petition is filed by the petitioner / A1to suspend the sentence imposed as against him by the learned Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Madurai, in S.C.No.14 of 2015, dated 29.11.2021. The petitioner / A1 has been tried, found guilty, convicted and sentenced by the trial Court to undergo one year imprisonment and a fine of Rs.1000/-, i/d to undergo simple imprisonment for three months, for the offence u/s.342 r/w 34 IPC; to undergo ten years imprisonment and a fine of Rs.1000/-, i/d to undergo simple imprisonment for one year, for the offence u/s.366 r/w 34 IPC; to undergo rigorous imprisonment for twenty years and a fine of Rs. 5000/-, i/d to undergo simple imprisonment for one year, for the offence u/s.5(g), 6 of POCSO Act; to pay a sum of Rs.50,000/- as compensation to the victim.

2.This is the sixth application filed by the petitioner to suspend the sentence. The earlier applications filed by the petitioners in CrlMP(MD)Nos.333 of 2022, 6940 of 2022, 652 of 2023, 15729 of 2023 2/5

3114 of 2024 were dismissed by this court on 17.02.2022, 18.08.2022, 30.03.2023, 21.12.2023, 17.03.2025 respectively. 3.This Court has already considered the available evidence and the Doctor's evidence and dismissed the earlier application on 17.03.2025. There is no change in circumstance since the dismissal of the earlier application. Therefore, this court is not inclined to entertain this petition. Accordingly, this petition is dismissed.

4.Considering that the typed set of papers are made ready and the petitioner is in jail, post the main appeal for final hearing under the caption 'Accused in Jail Cases' during the second week of April 2026. 12.03.2026 DSK 3/5
