ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 153(A), 504, 505(1)(b) I.P.C, in Crime No.109 of 2022, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that due to political motive, on 23.06.2022, the accused had arranged a Public Meeting, where the speakers were delivered speech by way of promoting the enmity between two religious with intend to provoke breach of peace and intentionally insult and issued statements in this regard. Hence, the complaint.
3. On the side of the petitioner, it is stated that the petitioner is innocent and he had committed any such offence, as alleged by the prosecution. He is no way connected with the offence. No overt act attributed as against this petitioner and in this case Section 153 IPC will not attract as against him. The Police has not filed any case, as against other speakers. Hence, prays to release him on anticipatory bail.

4. On the side of prosecution, it is stated that the accused intentionally insults, and thereby gives provocation to the public, knowing well that such provocation will break the public peace. The petitioner has only convened the meeting and he is having two previous cases. If he released on bail, he would indulge in similar kind of offences and in this case, investigation is not yet completed. Hence, prays to dismiss the petition. 5.Considering the facts and circumstances of the case, nature of serious allegations levelled against the petitioner and also considering the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition stands dismissed.
