PRAYER :- For Bail in Crime No.547 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner is arrayed as accused No.3. He was arrested and remanded to Judicial Custody on 11.09.2022 for the offence punishable under sections 489A, 489B, 489C IPC in Crime No. 547 of 2022 on the file of the respondent police. He seeks bail. 2.The case of the prosecution is that due to rival motive, A1 went to the hotel of the defacto complainant for eating food and gave a fake currency of Rs.500/- for bill. 3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any

offence as alleged by the prosecution. He would further submit that based on the confession of A1 only the petitioner herein is arrayed as A3 and seeks bail.

The learned Additional Public Prosecutor would submit that totally five accused involved in this case and the A3 gave a fake currency of Rs.2,500/- to A1, in turn, A1 has circulated the same into the hotel. He would further submit that based on the confession of A1 the petitioner herein is arrayed as accused and the investigation of the case is pending. He further contended that A1, A2 and A4 already arrested and still in custody and strongly objected to grant bail to the petitioner.

Considering the submission made by the learned Additional Public Prosecutor appearing for the respondent and that the petitioner has committed serious nature of offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
