PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 1st and 2nd respondent herein to take necessary action and conduct enquiry based on the complaint of the petitioner and CSR NO. 141 of 2025 on the file of the 2nd respondent police dated 04.02.2025.

The petitioner with a grievance that his complaint registered in CSR No.141 of 2025 has not been enquired by the respondent police, has filed this writ petition, seeking a direction. 2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents and submits that this petitioner's complaint has been duly enquired and a case in Crime No.377 of 2025 has been registered on 12.08.2025, for the offence under Section 303(2) of BNS.

3.The case of the petitioner is that he has lost his jewels, while he was travelling in TNSTC bus. For the occurrence said to have taken place on 03.02.2025, this petitioner appears to have lodged a complaint immediately before the respondent police. However, the case has been registered only on 05.08.2025, after filing of this petition.

4.The learned Additional Public Prosecutor submits that they have initially treated the complaint of this petitioner as a petition enquiry in CSR No.141 of 2025 on 04.02.2025. They have conducted the petition enquiry, however, they were not in a position to find out the culprit and therefore they have not registered the case.

5. It is very unfortunate that the respondent police have taken six months time for registering a case of theft. Though this Court is not appreciating the manner, in which, the complaint of this petitioner has been dealt by the respondent police and also considering the fact that the victim has been made to suffer by filing an application before this Court even for registering a case, this writ petition is closed with a direction to the respondent police to conduct the investigation in a fair and proper manner.
