The petitioner, one of the victims in Crime No.11 of 2025 has filed this petition, seeking transfer of investigation from the file of Central Crime Branch to some other investigation agency. 2.The learned counsel appearing for the petitioner submits that the petitioner has deposited a sum of Rs.22,79,000/- with one Premalatha and Ramesh, believing their words that the petitioner would get double the amount within a short span of time. Based on the complaints of several depositors like the petitioner, a case in Crime No. 11 of 2025 has been registered for the offence under Section 318(4) of BNS, 2023 and 5 of Tamil Nadu Protection of Interest of Depositors (in Financial Establishment) Act, 1997 and Sections 3 and 21(3) of the Banning of unregulated Deposit Schemes Act, 2019 (BUDS Act, 2019). According to the petitioner, the police officials are colluding with the accused and they have not taken any action to arrest the accused persons. 2/6
3.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side) submits that the case was registered only on 11.04.2025, for the offence under Section 318(4) of BNS, 2023 and 5 of Tamil Nadu Protection of Interest of Depositors (in Financial Establishment) Act, 1997 and Sections 3 and 21(3) of the Banning of unregulated Deposit Schemes Act, 2019 (BUDS Act, 2019). According to the learned Government Advocate, there are 175 victims in this case and the amount involved in this case is Rs.11.12 Crores. Since the value of the fraud is more than three crores, steps have been taken for transfer the investigation from the file of the Central Crime Branch to Economic Offences Wing.
4.This Court considered the rival submissions made and also perused the materials placed on record.
5.The case in Crime No.11 of 2025 was registered on 11.04.2025 for the offence under Sections 318(4) of BNS, 2023 and 5 of Tamil Nadu Protection of Interest of Depositors (in Financial Establishment) Act, 1997 and Sections 3 and 21(3) of the Banning of 3/6
unregulated Deposit Schemes Act, 2019 (BUDS Act, 2019) and the amount involved in this case is Rs.11.12 Crores. While so, the respondent police, in all fairness ought to have transferred the investigation to Economic Offences Wing. It is not known under what circumstances, the investigation is kept pending with the CCB for the past four months.
6.In view of the above, this Court directs the Commissioner of Police, Madurai to transfer the investigation in Crime No.11 of 2025 from the file of the CCB, Madurai to the Economic Offences Wing, Madurai, within a period of two weeks from the date of receipt of a copy of this order. The Economic Offences Wing, Madurai shall commence the investigation without any further loss of time. 7.With the above directions, this criminal Original Petition is disposed of.
