ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 323, 498(A), 313 IPC and Section 4 of Dowry Prohibition Act, in Crime No.210 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the marriage between A1 and the defacto complainant was solemnized on 07.02.2022 and thereafter, the A1 and other accused have tortured the defacto complainant by demanding additional dowry and also tortured her both mentally and curelly. Further, A1 has also stated in the
drunkenmood that he is in some affair with another lady, viz., the petitioner herein. Hence, a case has been registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner is only working with A1 in the same station and she has not committed any offence as alleged by the prosecution and her name has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner is a paramour of A1 and the petition filed by her was dismissed by the Principal Sessions Judge, Theni, in Crl.M.P.No.3603 of 2022 and hence, he strongly opposed to grant anticipatory bail to the petitioners.
5. Considering the facts and circumstances of the case and the nature of offence and also the submission made by the learned Government Advocate (Crl.Side) appearing for the respondent, this Court is not inclined to grant anticipatory bail to the petitioner.
5. Accordingly, this Criminal Original Petition is dismissed.
