CRL OP(MD). No.17457 of 2022 2.The case of the prosecution is that the accused assaulted the de-facto complainant with dire consequences. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. He would further submit that the co-accused have already released on bail by the Sessions Court. 4.The learned Government Advocate (Crl. side) would submit that the de-facto complainant is still in hospital and the first petitioner is having 13 previous cases and the other petitioners are having no previous case. The investigation is in preliminary stage. Hence, he strongly opposed to grant anticipatory bail. 5.
Considering the gravity and nature of the offence and also considering the facts that the injured is yet to be discharged from the hospital and the investigation is in preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 29/09/2022 / TRUE COPY / /10/2022 Sub-Assistant Registrar (C.S.)
