ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This Habeas Corpus Petition is filed to direct the respondents 1 and 2 herein to produce the person or body of the detenue by name Priyadharshini, D/o.Ramesh, Female, aged about 17 years before this Court and handed over the custody.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2 . 3.The case of the petitioner is that the petitioner's daughter was born on 14.05.2008 and she has completed 12th standard. She was pursuing nursing 2/6
course. As usual on 15.07.2025, the petitioner's daughter went to college. But, she did not return back home. After due search, the petitioner was unable to trace her. Later, he came to know that her daughter was abducted by the third respondent. Hence, the petitioner had given a complaint to the second respondent to find out the whereabouts of the petitioner's daughter. Since no action has been taken by the respondent Police, the present habeas corpus petition is filed. 4.When the matter came up for admission on 07.08.2025, this Court directed the matter to be listed next week. Again on 14.08.2025, this Court directed the matter to be listed on 22.08.2025. 5.A mention was made by the learned Additional Public Prosecutor in the morning stating that the alleged missing person has been secured and that she would be produced before this Court.
6.Pursuant to which, the missing person is produced before this Court. 7.We enquired the missing person, she stated that the petitioner is her 3/6
mother and the third respondent is known to her and hence, he had gone along with him. After being traced, she has come along with the police officials and she had expressed her willingness to go along with her mother. 8.Recording the submission made by the missing person, this Habeas Corpus Petition stands closed. The girl has been handed over to the petitioner, who is the mother of the missing person.
