PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent to measure the land in New S.No.123/2, Old S.No.77/1 to an extent of 2 1/2 cents situated in Inam Pudhur Village Group, Manaparrai Taluk, Trichy District and direct the 2nd respondent to issue Natham patta converted from Housing Scheme Development Patta for the same in the name of the petitioner herein. 1/4

ORDER

By relying on HSD patta issued on 05.07.1990 to the petitioner, the petitioner had applied for measuring land in new S.No.123/2 corresponding to old S.No.77/1. The petitioner received a reply stating that O.S.No.54 of 2019 is pending and that the request would be considered depending on the outcome of the suit.

2. Learned counsel for the petitioner submits that the suit pertains to land in S.No.123/26 and not S.No.123/2.

3. Learned Government Advocate submits that patta has been issued to one Krishnan in respect of land in S.No.123/2. Therefore, he submits that the petitioner cannot seek a mandamus without challenging the patta issued to Krishnan in accordance with law.

4. Against an order granting patta to a person, the appellate remedy is available before the Revenue Divisional Officer. Therefore, by leaving it open 2/4
