ORDER

This Civil Revision Petition is filed for a direction to set aside the order dated 17.11.2023 in E.P.No.257 of 2021 in O.S.No.135 of 2018, on the file of Principal District Court, Dindigul and to allow this Civil Revision Petition. 1/4

2. The petitioner is the defendant in O.S. No. 135 of 2018. The respondent/plaintiff filed a suit for the recovery of Rs.24,19,000/-. The suit was decreed on 12.04.2019. Earlier, the scheduled property was attached in I.A. No. 219 of 2018 under Order XXXVIII Rule 5 of the Code of Civil Procedure on 13.10.2018. Subsequently, the respondent/plaintiff filed E.P. No. 257 of 2021 to auction the property. Challenging the order passed in E.P. on 17.11.2023, the petitioner has filed the present civil revision petition.

3. When the matter was taken up for hearing today, the learned counsel for the petitioner submitted that the auction was conducted yesterday and therefore, no issues remain for further adjudication.

4. Recording the same, the civil revision petition stands dismissed as infructuous. No costs. Consequently, the connected miscellaneous petition is closed.
