ORDER

By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself.

This writ petition has been filed for a mandamus to direct the 1st respondent to release the pension in favour of the petitioner upon her mother's family pension payment order in PPO No. FC/528469/PW dated 26.11.2002 in the light of the certificate issued by the village Administrative Officer, Thiruvathavoor Village, Melur Taluk, Madurai District dated 09.10.2023.

3. The learned counsel for the petitioner would submit that the name of the petitioner is one Ayyammal and her father was appointed as Lascar and he died on 25.03.1958. After his death, the petitioner's mother was issued with the family pension till her death, ie., 06.12.2015. 2/6

Subsequently, the petitioner and her sister are eligible for family pension and since her sister had got settled, she gave no objection for the petitioner to receive the family pension. While so, when the petitioner approached the 2nd respondent for family pension, it was not sanctioned on the ground that the name of the petitioner is not found in the original pension case, whereas, the name of Nagalakshmi alone found a place. Hence, the petitioner was directed to obtain a certificate from the Tahsildar to the effect that both Nagalakshmi and Ayyammal is one and the same person. The learned counsel however would submit that the name 'Nagalakshmi' was used by village people, whereas, as per the certificate, the petitioner's name is Ayyammal and the Tahsildar has no power to issue such a certificate. Hence, the petitioner made a representation to consider her pension proposals. Since the same has not been considered so far, the petitioner is before this Court.

4. Heard the learned Special Government Pleader and the learned counsel for the respondents.

Considering the limited scope of the matter and considering the legal heirship certificate issued by the 2nd respondent dated 15.11.2016, the 2nd respondent is directed to send necessary proposals on the basis of the legal heirship certificate dated 15.11.2016, which bears the name as 'Ayyammal', to the first respondent within a period of one week from today and on receipt of the same, if there is no counter claim, the first respondent is directed to consider the same within a period of one week thereafter, ie,. on or before 25.08.2025.

6. The writ petition is disposed of with the above direction. No costs.

7. List the writ petition under the caption, 'for reporting compliance' on 26.08.2025.
