PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the entire records in connection with the impugned orders passed by the third respondent vide proceedings vide Ref No.Na.Ka.No.24/S.EC/2023, dated 17.08.2023 and quash the same and consequently direct the respondents herein to grant permission to put up a new flag pole and to hold a General Body meeting on the requested location.

This Writ Petition is filed under Article 226 of the Constitution of India by way of Certiorarified Mandamus, seeking for a direction to the respondent Police to grant permission to the petitioner to conduct General Body meeting at Alanganallur on 27.08.2023, by setting aside the proceedings of the respondent Police, dated 17.08.2023, vide Na.Ka.No.24/S.EC/2023.
2. According to the learned counsel, the petitioner is intended to perform the General Body meeting of Bharatiya Mazdoor Sangh at Alanganallur, however, the respondent Police without any reasonable ground has allegedly refused permission, hence sought for suitable directions.

During the course of submissions, learned Government Advocate (Criminal Side) submitted that the respondent Police have no objections for granting permission for conducting the General Body meeting on 27.08.2023. However, the place where the petitioner is proposed to conduct the meeting is meant for conducting the meetings of political parties only and further the petitioner also intends to plant flag rod at that place, thereby, the permission is declined.

4. The learned counsel for the petitioner after getting instructions from the petitioner, reports that the petitioner has no objection, in case, if the permission is granted for conducting the meeting near Vadivasal Nadagamedai.
5. In view of the above, this writ petition is disposed of, directing the petitioner to approach the respondent Police afresh by filing an application, on which, the respondent Police are directed to provide permission to conduct the General Body meeting on 27.08.2023 as sought for. No costs.
