This writ petition has been filed seeking a direction to the 1st and 2nd respondents to survey the common pathway in bearing survey No. 205 Cents situated in Pulliyurani Village, Marakathur Group, Kalayarkovil Taluk, Sivagangai District by considering petitioner's representation dated 10.08.2023 by giving adequate police protection at time of survey, within the time that may be stipulated by this Court.
2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents 1 to 4 and 6.
3. The petitioner submitted a representation on 10.08.2023 to the respondents 1 and 2 to survey the common pathway in bearing survey No.205 Cents situated in Pulliyurani Village, Marakathur Group, 2/5
Kalayarkovil Taluk, Sivagangai District. However, no action has been taken on the said application. Hence, the present writ petition has been filed.
4. Learned Government Advocate, appearing for the respondents, submits that the representation of the petitioner would be considered by the respondents 2 and 4 within a time stipulated by this Court.
5. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 2 and 4 to consider the petitioner's representation dated 10.08.2023 on merits and in accordance with law, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. Needless to say, if any rival claims, the same shall be subject to the jurisdiction of the civil Court. There shall be no order as to costs.
