the order dated 15.05.2023 passed by the 3rd respondent in Na.Ka.No. 178/A3/2023 and quash the same and consequently direct the respondents to provide suitable job to her son namely Marikannan, S/o. Late. Ramaiah, aged about 22 years on compassionate ground within the time stipulated in accordance with law.

ORDER
This writ petition has been filed challenging the order dated 15.05.2023 passed by the third respondent in Na.Ka.No. 178/A3/2023 with a consequential direction to the respondents to provide suitable job to the petitioner's son, namely Marikannan, on compassionate ground within the time stipulated in accordance with law.
2. Heard the learned counsel on either side and perused the materials placed before this Court.
3. The petitioner's husband, who served as Assistant in the fourth respondent office, died in harness in the year 2013. After his death, the 2/6
petitioner made a representation seeking compassionate appointment and a communication has been issued stating that the petitioner's application has been forwarded to the Secretariat. While this being so, the petitioner sent another representation to the respondents seeking compassionate appointment for her son. However, the same was rejected through the impugned order. Challenging the same, this writ petition came to be filed stating that the second application seeking compassionate appointment cannot be considered.
4. The learned counsel appearing for the petitioner submits that from the year 2013, several representations were made by the petitioner seeking compassionate appointment. However, without answering the same, the present impugned order came to be passed and hence, the same is liable to be dismissed. He further submits that the petitioner's educational qualification is only fourth standard and hence, the application seeking for compassionate appointment for her son may be considered.
5. The learned Additional Government Pleader appearing for the respondents denied the averments made by the petitioner, by way of his counter affidavit.

Considering the facts and circumstances of this case, this Court, on a sympathetic ground, quashes the impugned order dated 15.05.2023 and the matter is remanded back to the third respondent for a fresh consideration. The third respondent is directed to pass appropriate orders in the case of the petitioner, on merits and in accordance with law, preferably, within a period of two months from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.
7. With the above observations and directions, the Writ Petitions stand disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
