ORDER
The petitioner seeks quashing of the FIR in Crime No.167 of 2024 on the file of the first respondent, which was registered for the offences under Section 126(2), 296(b), 351(2) of BNS, 2023 and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002, mainly on the ground that the allegations are false and the FIR has been lodged only as a counter blast to the complaint given by the petitioner's wife against the husband of the second respondent and others in Crime No.166 of 2024 for the offences under Section 296(b), 79, 351(2), 308(3) of BNS, 2023 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.
2. The learned Additional Public Prosecutor would submit that the investigation is at the advanced stage in both the crime numbers.
3. The point raised by the petitioner, that the allegation in the FIR is false, cannot be adjudicated in this quash petition. However, it is seen that the complaint of the petitioner's wife has been registered in Crime No.166 of 2024 and the complaint against the petitioner is registered in Crime No.167 of 2024. It is seen that the FIR against the petitioner and the FIR lodged by the petitioner's wife pertain to two different incidents. The respondents shall 2/4
conduct the investigation in a fair manner and file final reports in accordance with law. In view of the same, this Court finds no reason to quash the FIR on the ground raised by the petitioner. Hence, the Criminal Original Petition stands dismissed.
