ORDER

This writ petition has been filed for a Mandamus to direct the first respondent to issue passport to the petitioner based upon the application No.MD107734835325 dated 28.01.2025.

2. The petitioner was earlier holding passport bearing No.X9923046. which was valid for a period between 31.05.2023 and 30.05.2025.

3. The learned Government Advocate for the respondents 2 and 3 submits that the petitioner has been arrayed as Accused No.1 in an FIR registered by the third respondent in Crime No.12 of 2020 for offences under Sections 120B, 406, 465, 468 and 420 of the IPC.

4. The learned Government Advocate for the respondents 2 and 3 submits that a charge sheet has been filed on 16.03.2024 before the Judicial Magistrate - I, Madurai. However, the same has not taken on file. 2/5

5. Considering the fact that no criminal case is pending against the petitioner, there can be no impediment in directing the first respondent to process the petitioner's passport application.

6. Accordingly, the first respondent is directed to process the passport application of the petitioner and issue passport to the petitioner as expeditiously as possible.

7. It is also made clear that in case charge sheet is taken on file before the Judicial Magistrate - I, Madurai, the petitioner shall voluntarily surrender the passport before the concerned court and retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application. If the petitioner fails to comply with this condition, the first respondent is at liberty to cancel the passport.
