ORDER

The writ petition is filed seeking a direction to the respondents 3 and 4 to implement the order passed by the 1st respondent in the second appeal in No.NC909/C/2023/SA16459/C/2022 dated 09.11.2023.

2. Heard the learned counsel appearing for the petitioner, Ananth C.Rajesh, learned counsel who takes notice for the 1st respondent and Mr.D.S.Nedunchezhian, learned Government Advocate who takes notice for the respondents 2 to 6.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, he filed an application under RTI Act, seeking certain informations from the 5th respondent. Since there was no response from the 5th respondent within the statutory period, the petitioner filed the first appeal on 01.08.2022 before the 4th respondent. The 1st Appellate Authority failed to dispose of the appeal within the time limit. Hence, the petitioner was constrained to file the second appeal before the 1st respondent on 15.09.2022.

The second appeal was disposed of by the 1st respondent on 09.11.2023, directing the respondents 3 and 4 to take action against the 5th respondent and also pay a sum of Rs.20,000/- as compensation to the petitioner for denying information and inspite of direction issued by the 1st respondent as early as on 09.11.2023. The respondents 3 and 4 have not taken any action against the 5th respondent and also paid the compensation. Therefore, the petitioner submitted a representation before 3/6

the 1st respondent on 19.04.2025, complaining violation of the order. However, the same has not been considered. Hence, the petitioner has come before this Court, seeking above mentioned prayer.

A perusal of the typed set of papers would indicate the 1st respondent in second appeal in No.NC909/C/2023/SA16459/C/2022 dated 09.11.2023, passed an order directing the respondents 3 and 4 to take action against the then incumbent of the 5th respondent office and also directed payment of compensation to the petitioner. The violation of the said order was brought notice to the 1st respondent by the petitioner in his representation dated 19.04.2025.

In view of the same, without expressing any opinion on the merits of the matter, this Court is inclined to direct the 1st respondent to consider the representation submitted by the petitioner dated 19.04.2025, complaining the violation of the order dated 09.11.2023 and pass final orders on its own merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order. 4/6

8. The writ petition is disposed of with the above observations. No costs.
