ORDER
The revision petitioners / defendants 4 to 8 have filed this revision to set aside the order, dated 23.10.2021 made in I.A.No.15 of 2021 in O.S.No.207 of 2008 on the file of the Additional District Munsif, Karaikudi.
2.. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The said Interlocutory Application in I.A.No.15 of 2021 filed by the revision petitioners / defendants 4 to 8 to appoint an Advocate Commissioner to examine the revision petitioners / defendants through the Advocate Commissioner. The reason for appointing the Commissioner is that the 4th defendant is aged about 81 years and also he is having health issues and unable to attend the Court and hence, the Advocate Commissioner can be appointed. Except the fourth defendant, other four defendants are there and two of the defendants are aged about 70 years. So, they know the facts of case fully and hence, the trial Court has rightly dismissed the application. Therefore, this court has not find any valid reason to interfere with the order passed by the Court below.
4. Accordingly, this Civil Revision Petition is dismissed by confirming the order, dated 23.10.2021 made in I.A.No.15 of 2021 in O.S.No.207 of 2008 on the file of the Additional District Munsif, Karaikudi. No costs. Consequently, the connected Miscellaneous Petition is closed.
