ORDER : The Court made the following order :- The petitioner, who arrayed as accused, was arrested and remanded to judicial custody on 26.06.2024 for the offences punishable under sections 452 IPC and 6, 5(1), 5(j)(ii) of POCSO Act, in Crime No.252 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein has sexually assaulted the victim girl, who is aged about 16 years and now she became pregnant. Hence, the compliant.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he is in judicial custody from 26.06.2024 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the victim is 14 years and the investigation of the case is pending. He further submitted that there are 12 previous cases pending against the petitioner and hence, he strongly opposed to 2/4

grant bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering serious nature of allegations made against the petitioner, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 04.09.2025 TRP TO 1.The Inspector of Police, Karivalamvanthanallur Police Station, Tenkasi District.
