ORDER
The petitioner/defacto complainant in Crime No.881 of 2016 has filed this petition, seeking a direction to the respondent police to 1/5
conclude the investigation in Crime No.881 of 2016, within a stipulated time.
2.When the matter is taken up for hearing today, there is no representation for the petitioner.
3.The case of the petitioner is that the case in Crime No.881 of 2016 was registered on 14.11.2016, for the offence under Sections 147, 148, 294(b), 324, 307 IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992. However, the respondent police has not filed the final report so far. The petitioner has already filed a petition before this Court in Crl.OP(MD) No.5399 of 2055, wherein, this Court, by its order, dated 24.03.2025 has closed the petition, recording the submission of the respondent police that the final report in the above crime number has already been filed even in the year 2016. When the petitioner filed a copy application before the Magistrate Court, it was returned citing no final report has been filed in the above crime number. Therefore, the petitioner is constrained to file this petition once again.

4.The learned Government Advocate (Crl.side) appearing for the respondent submits that the final report was originally filed on 12.07.2022 and it was returned by the Judicial Magistrate Court on 01.07.2023 stating that Form 91 and Wound Certificate were not found along with the final report filed by the respondent police. Since the occurrence was taken place in the year 2016, they were not in a position to restore the wound certificate. However, with great difficulty they found the Medical officer, who issued the wound certificate and obtained a fresh wound certificate and filed the same before the concerned Court. Now, the final report has been taken on file on 08.08.2025. 5.This Court considered the rival submissions made and also perused the materials placed on record.
6.Since it is reported that final report has already been filed, on 08.08.2025, this criminal original petition is closed. 20.08.2025 NCC : Yes/No Index : Yes/No Internet:Yes gns 3/5
