PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the second respondent to issue separate patta based on my application 2025/0105/23/307554 dated 19.05.2025 within the period that may be stipulated by this Court.

O R D E R

This Writ Petition has been filed seeking for a direction to the second respondent to issue separate patta based on the petitioner's application dated 19.05.2025.

2.The petitioner and the fourth respondent are claiming right over the same landed property as their ancestral property. The petitioner approached the Tahsildar, Thiruppuvanam Taluk, and gave an application seeking for issuance of separate patta, since there is a joint patta in the 2/6

name of the petitioner and his brothers. Likewise, the fourth respondent claiming right over the same property, has made an application to the District Revenue Officer, Sivagangai, for updating the register, stating that there are some mistakes in the UDR.

3.Both parties are present and by considering their arguments, this Writ Petition is disposed of at the admission stage itself. 4.Any corrections relating to UDR will have to be decided by the District Revenue Officer. Since both the applications of the petitioner as well as the fourth respondent are pending before the Tahsildar and the District Revenue Officer, respectively, this Court feels that it would be appropriate to direct the District Revenue Officer for appropriate action. 5.Accordingly, the District Revenue Officer, Sivagangai, is directed to conduct an enquiry on the representations made by the fourth respondent and pass orders on merits and in accordance with law, within a period of eight [8] weeks from the date of receipt of a copy of this order. Based on the outcome of the enquiry to be conducted by the District Revenue Officer, the Tahsildar, Thiruppuvana Taluk, is at liberty to proceed with the representation made by the petitioner, thereafter. 3/6

6.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
