For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 181 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioners/Accused No.1 & 2, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 353, 294(b) and 506(ii) IPC in Crime No.181 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 27.11.2021, the petitioners had prevented the lawful duty of the defacto complainant and criminally threatened him with dire consequences. Hence, the complaint.

3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent; not committed any offence as alleged by the prosecution and a false case has been falsely foisted against them. Hence, he seeks for grant of anticipatory bail.

CRL OP(MD). No.19021 of 2021 4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the that the investigation is not yet completed and that the petitioners are having two cases of similar nature.

5.Considering the seriousness and gravity of the offence alleged and the also the facts that the alleged occurrence was only through the cell phone of the second petitioner, that the investigation is pending and that the petitioner is having two cases of similar nature, as stated by the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
