O R D E R

The Writ Petition is filed challenging the order passed by the second respondent dismissing the application submitted by the Petitioner seeking cancellation of patta in respect of the property in S.Nos.1194/3 and 1565/3 situated at Enjar Village, Sivakasi Taluk, Virudhunagar District.

2.Mr.M.Gangadharan, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.A perusal of the impugned order passed by the second respondent would indicate that the Petitioner had effectively participated in the enquiry and he also made a statement before the second respondent. Therefore, there is no violation of natural justice principles to enable the Petitioner to approach this Court to straight-away, by-passing the statutory revision to be filed under 2/5

section 13 of the Tamil Nadu Patta Passbook Act. Therefore,this Court is not inclined to entertain the present writ Petition and hence, the same stands dismissed, with liberty to the Petitioner to work out his remedy by filing a revision before the first respondent. No costs.

4.The learned counsel for the Petitioner by drawing the attention of this Court to the order passed by the Division Bench of this court in W.A(MD)No.1180 of 2021 relegating the parties to the Civil Court. Till date, the Petitioner has not filed any civil suit as per the direction issued in W.A(MD)No.1180 of 2021.If the Petitioner is so advised, it is always open to him to work out his remedy before the Civil Court.
